Definitions

  • "Account" means an account set up by a User on the Company Website.
  • "Company" means Click-Quote-Done
  • "Customer" means any User that registers an Account on the Website with the express purpose of contacting a Service Provider in order to enquire about a Job.
  • "Email" means electronic mail sent or received by the Company either by a member of the Company or automatically on behalf of the Company.
  • "Enquiries" means any contact from a Customer to a Service Provider for Work.
  • "Intellectual Property Rights" means patents, rights to inventions, copyright and related rights, trade marks, business names and domain names, rights in get-up, goodwill and the right to sue for passing off, rights in design, database rights, rights to use, and protect the confidentiality of, confidential information (including know-how), and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, renewals or extensions of, and rights to claim priority from, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist now or in the future in any part of the world.
  • "Job" means any work, project or job submitted on the Website.
  • "Pricing" or means charges applicable to the Service Provider for the Services provided by the Company including but not limited to Job Leads and subscription services.
  • "Service" means any product or service that is provided by the Company to a User which includes, but is not limited to, information, services and products provided through the Website or by telephone or Email.
  • "Sub-Contractor" means any contractor, sub-contractor and sole trader, or any other person or company working with, or contemplated by the Service Provider to be likely to work with, or for or on behalf of a Service Provider in connection with the Work.
  • "Suspended" means the temporary abeyance of a User's Account with the Company.
  • "System" means the software, hardware, batch programmes, and automated processes that are used by the Company in order to provide components of the Service.
  • "Terms and Conditions" means these Terms and Conditions and Privacy Policy.
  • "Text" means short message service (SMS) sent or received by the Company either by a member of the Company or automatically on behalf of the Company.
  • "Service Provider" means any User that registers an Account on the Website in order to receive Enquiries to help them obtain a Job from a Customer.
  • "User" means the users of the Website collectively.
  • "We/us/our/ClickQuoteDone.com" means Click-Quote-Done.
  • "Website" means the website ClickQuoteDone.com and any subdomains including the pages, content and graphics contained within or any subsequent URL which may replace it.
  • "You/your" means a User of the Website.

1. Terms of Use of the Website

1.1 By using the Website you agree to be bound by these Terms.

1.2 We reserve the right to update and amend these Terms from time to time and any changes will be notified to you via a suitable announcement on the Website. It is your responsibility to check for such changes. The changes will apply to the use of the Website after we have given such announcement. If you do not wish to accept the new Terms you should not continue to use the Website. If you continue to use the Website after the date on which the change comes into effect, your use of the Website indicates your agreement to be bound by the new Terms.

1.3 While every effort is made to ensure continued access to the Website we shall not be liable to you for any loss of access or interruption of your use of the Website. In the event that it is necessary for us to withdraw your access to the Website in order to carry out essential maintenance then we will make reasonable steps to ensure that you are made aware of this when attempting to access the Website.

1.4 Any complaints should be directed to our customer service helpdesk on support@clickquotedone.com. If you experience a fault on the Website please report it by emailing support@clickquotedone.com.

1.5 We reserve the right to modify or withdraw, temporarily or permanently, this Website and the material contained within (or any part) without notice to you and you confirm that we shall not be liable to you for any modification to or withdrawal of the Website or its contents.

1.6 We are fully committed to compliance with the requirements of the Data Protection Act 1998. Our data protection policy sets out our commitment to protecting personal data and how we implement that commitment with regards to the collection and use of personal data. Our privacy policy is set out in Section Two.

1.7 The use of this Website and any contract formed through or on the basis of information provided through the Website shall be subject to English Law and any dispute arising from such use or relating to such a contract shall be heard exclusively by the courts of England and Wales.

2. Compliance

2.1 The Website may only be used for lawful purposes and in a lawful manner.

2.2 You agree to comply with all applicable laws, statutes and regulations regarding the Website and its use.

2.3 You agree not to upload or transmit through the Website:

2.3.1 any computer viruses or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer and;

2.3.2 any material which is defamatory, offensive or of an obscene character.

3. Indemnity

3.1 You agree to fully indemnify, defend and hold us, and our officers, directors, employees and suppliers, harmless immediately on demand, from and against all claims, losses, costs and expenses, including reasonable legal fees, arising out of any breach of these Terms by you, or any other liabilities arising out of your use of this Website or any other person accessing the Website using your personal information.

3.2 You understand and agree that the Company is not party to any contract made between the Company and the Service Provider (and/or its Sub-Contractors) in relation to a specific Job and accordingly the Company shall not be liable to the Service Provider (and/or its Sub-Contractors) for any occurrence resulting from any dealings between the Service Provider (and/or its Sub-Contractors) and the Customer including, but not limited to, any direct, indirect or consequential or inconsequential loss of any kind suffered by either the Customer of the Service Provider (and/or its Sub-Contractors) howsoever arising.

3.3 The Company is not responsible for any interruption of Service and accepts no liability for any other form of loss suffered by the User as a direct result of this interruption.

4. Third Party Links

As a convenience to our Users, the Website may include links to other websites or material which is beyond our control. For your information, we are not responsible for such websites or material nor do we review or endorse these. We will not be liable, whether directly or indirectly, for the privacy practices or content of such websites or for any damage, loss or offence caused or alleged to be caused in connection with, the use of or reliance on any such advertising, content, products, materials or services available on such external websites or resources.

5. Severance

If any provision (or part of a provision) of these Terms is found by any court or administrative body of competent jurisdiction to be invalid, unenforceable or illegal, the other provisions shall remain in force.

6. Third Party Rights

Other than where expressly stated in this agreement a person who is not a party to these terms shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but nothing in this clause 19 shall affect the rights of a person that are not derived by virtue of that Act

7. Registration

7.1 By registering with www.clickquotedone.com, you agree that:

7.1.1 the information you provide is true and accurate;

7.1.2 you are not impersonating any other person or entity or creating multiple or false Accounts; and

7.1.3 you will notify us immediately of any changes to your personal information by e-mailing our customer service department at support@clickquotedone.com.

7.2 If you breach these, or any of our other Terms, we reserve the right to close your Account. If we do so, we may close all Accounts you have open in your name.

8. Termination of Account

8.1 Termination of your Account will only be actioned after written request from your registered Email address.

8.2 Termination of your Account may take up to 5 days.

8.3 You understand and agree that if you ever choose to close your Account, any outstanding charges will be taken from your debit/credit card, immediately.

8.4 Cancelling your membership does not cancel your agreement to our Terms and Conditions.

9. Intellectual Property

9.1 The Company owns all the Intellectual Property Rights relating to the Website, including the layout, design, content, graphics and database and you agree not use or copy any part thereof without our prior permission.

9.2 You certify to the best of your knowledge, that any information you post on this site is accurate and that you are authorised to post this information. Any materials you upload remain the property right of the owner and are uploaded at the User's risk. In doing so you are giving expressed and irrevocable permission for us to store, display and use the content.

10. Content

10.1 You agree to use the Website for lawful purposes only and in a way which does not infringe the rights of or restrict or inhibit anyone else's use and enjoyment of the Website.

10.2 You understand and agree that any details, including contact information, obtained by you through the Website, remain the intellectual material of the Company and that you will not sell or give this information to other organisations nor individuals.

10.3 You shall not:

10.3.1 Provide copyrighted materials without authorisation.

10.3.2 Provide obscene or offensive material.

10.3.3 Provide material whose nature and/or volume compromises the ability of the Company to serve our Website (instances including but not limited to unreasonable consumption of disk space, Internet link bandwidth, CPU, and memory usage, as determined by the Company's staff).

10.3.4 Provide materials that are deemed by the government authorities as inappropriate or illegal. Any such government determinations will be binding on the User, not the Company.

10.4 You agree that you are responsible for the validity of the mobile number used for Texts and that any failure to receive messages due to lack of signal, the number being inaccurate, turned off, out of service or other reason, is your responsibility.

10.5 You understand and agree that we reserve the right to remove any and all information that you have entered for any reason and specifically for system abuse.

Customer Terms & Conditions

1. General Terms

1.1 The Customer understands and agrees that the Company relies on them to accurately specify and describe their Job requirements.

1.2 The Company makes no warranty for the accuracy or completeness of any information provided by the Customer.

Service Provider Terms and Conditions

1. General Terms

1.1 The Service Provider understands and agrees that they are solely responsible for ensuring that they are legally able to tender and carry out any work received through the Service.

1.2 The Service Provider is also solely responsible for any work carried out by a Sub-Contractor and will ensure that they are legally able to carry out any Job received through this Service.

1.3 The Service Provider understands and agrees that we are sending you Enquiries and not confirmed Jobs. It is the Customer's decision if they wish to hire you for the Job and the Company is not responsible if a Job does not materialise from any Enquiry.

1.4 The Service Provider certifies that they will be responsible for all works whether the work was done by themselves or by any additional/external Sub-Contractor.

1.5 Any dissatisfaction with a Job performed by a Service Provider may only be taken up by the Customer and is a matter between the Service Provider and the Customer only. Any complaint will not be resolved through the Company, its officers or employees.

1.6 The Service Provider will not hold the Company liable for any ratings given by a Customer found through this Service nor will the Company act as an arbiter in any rating disagreement.

2. "Jobs Matched" Membership Terms

2.1 The Service Provider understands and agrees that by upgrading their Account, the Company will use their current parameters to provide contact details of the Customer and that the Service Provider will be charged for these details immediately at the price displayed in the current Pricing chart.

2.2 The Company will only send the Service Provider for contact details of Jobs if:-

2.2.1 the Service Provider's Account is approved.

2.2.2 their Job notifications are switched on.

2.2.3 the Job matches the profile/parameters (job type, job size, distance/coverage map and Customer type) of the Service Provider.

2.3 It is the responsibility of the Service Provider to suspend Job notifications in their Account if they do not require further Enquiries.

2.4 The Company reserves the right to change the Pricing but will give the Service Provider one week's notice via Email if the Pricing formula changes on average more than 10% in any one year, in order to give the Service Provider sufficient time to review the changes and update your Account parameters should you wish to.

2.5 A Job will be allocated to a Service Provider based on its primary purpose but it may contain smaller associated work in the description (eg installing a shower may have some tiling work associated to it). The Service Provider understands and agrees that the Company will use this primary purpose to allocate the Job, even if smaller associated work is not selected by you in your profile.

2.6 It is the responsibility of the Service Provider to ensure the Job is completed in full.

3. Prices and Payment

3.1 We only accept donations in pound sterling and via PayPal.

3.2 We use PayPal as our payment gateway and they are able to accept MasterCard, Visa and American Express, although we reserve the right to refuse to accept any of these cards from time to time without notice.

3.3 We try hard to ensure that using your credit or debit card when you donate online is safe and secure. This is a secure site; all the details you enter are transmitted safely. You can check the security setting using your browser: the web address shown when you are on the payment page will start with https rather than http. 4. Refund Policy

4.1 The Service Provider will be eligible for a refund to their Account if:

4.2.1 they were never able to make contact (either by Email or telephone); or

4.2.2 when initially contacting the Customer, the Service Provider was told the Job had already been taken or had been removed.

4.3 Refunds will not be provided to a Service Provider if:

4.3.1 their profile is not complete and up to date including insurance details, accreditations and previous Customer references.

4.3.2 the travel distance to the Job exceeds 50 miles.

4.3.3 your average rating score is less than 3.

4.4 In order to be eligible for a refund, the Service Provider must report a "payment issue" in their Account within 14 days of making a donation. The Company will then verify all information provided by the Customer and any refunds will be at the Company's sole discretion.

4.5 Any refund will be minus credit bonuses, free or reduced charges and may incur an administrative fee.

4.6 Any abuse of the "payment issue" feature by a Service Provider may lead to their Account being Suspended without any refunds.

4.7 If you break any of these Terms & Conditions you will not be eligible for a refund.

4.8 Refunds of donations are only possible if requested within 14 days of the original donation, minus any bonuses, free or reduced charges.

4.9 Text subscription services are non-refundable. You understand and agree that it is your responsibility to turn off the monthly renewal if you do not wish to continue to use them.

4.10 A Service Provider is entitled to a full refund if any payment is taken in error.

4.11 Any refund payments will be paid to the Service Provider in pound sterling via a PayPal payment and will match the amount paid for the Enquiry.

Section Two: Privacy Policy

Privacy Policy

ClickQuoteDone.com is registered with the Data Protection Agency (number: ZA097480) We will never sell or pass on your personal data with any organisations who are not connected to this Website. Below we outline our Privacy Policy detailing how we store and use your personal information. This should also be read in conjunction with our Terms & Conditions.

1. Cookies

Our site requires your browser to support cookies. We use cookies to store your session while browsing our Website and to maintain your user state. No personally identifiable information is stored in the cookie and all data stored is encrypted.

2. JavaScript

We use JavaScript extensively on our Website to maintain a better user experience. Our JavaScript code may pass information submitted on our forms to our servers through AJAX for validation of your data. No information other than that you have entered is passed to the server with JavaScript.

3. Personal Data

Customers

3.1 Personal data including telephone numbers, names and Email addresses are used during the registration process. This data is only made available to the number of Job contacts that you have specified in your preferences.

3.2 We do not - unless you give us specific permission - publish telephone numbers, Email addresses or other personally identifiable information on any page of the Website.

3.3 We use your Email address to inform you when a Service Provider promises to contact you. Email addresses relating to a Job are only displayed after a Service Provider has had their quote accepted by a Customer - and which the Customer has made available for purchase.

3.4 We otherwise do not pass on or make available any contact details of a Job which is not otherwise publicly available and maintain the privacy of all Customers who prefer to remain anonymous.

3.5 When posting a Job we will send you an Email with an activation link to activate your account.

Service Providers

3.6 Personal data including names, telephone numbers, addresses and Email addresses are used during the registration process. This data is only made available to Customers after a lead has been accepted.

3.7 Email addresses are never disclosed except to homeowners for who you have purchased contact details. We use your Email address to inform you when a new Job has been allocated to you. We otherwise do not pass on any contact details of a tradesperson which is not otherwise publicly available and maintain the privacy of all and tradespeople.

3.8 Tradespeople can make available their details by means of their online advertisement. Any email address of a tradesperson is not made public through their advertisement.

3.9 Postcodes are used for calculating distances between Jobs, Customers and Service Providers. We require a postcode for all registration and Job creation pages to assist Users in their searches.

3.10 You can stop receiving Emails at any time from our Website by simply deactivating your advert. You may continue to log into your Account at any time. Reactivating your advert will also enable Emails being sent to you. We do not sent unsolicited or spam Email. Any Emails we send are pertinent to your Job advertisement or trade distance.

4. Third Party Software

We employ some third party JavaScript software. Where applicable we strongly recommend you review each of those party's privacy policies prior to using them. Our Website has no control over their software, terms, conditions or privacy statements.
